Here's something worth sitting with for a moment. Right now, in 2026, there is no law in the United States that explicitly protects your brain data.
Not your brainwave patterns. Not your neural signatures. Not the electrical fingerprint of your focus, your stress, your emotional state, or your cognitive decline. None of it has specific legal protection.
Your medical records? Protected by HIPAA. Your financial data? Protected by Gramm-Leach-Bliley. Your email? Protected (sort of) by the Fourth Amendment. None of this requires anyone to "read your mind" in the science fiction sense. It just requires pattern matching at scale, which is exactly what AI is good at.
Cognitive profiling doesn't stop at insurance. Imagine hiring algorithms that screen candidates based on their neural data. Admissions processes that include "cognitive assessments" via EEG. Threat 3: Mental Manipulation

The amendment added a single but powerful clause: "Scientific and technological development must be at the service of people and must be carried out with respect for life and physical and psychic integrity. The law shall regulate the requirements, conditions, and restrictions for its use in people, and must especially protect brain activity, as well as the information derived from it."
A companion law followed in 2024, establishing five specific protections:
- The right to mental privacy
- The right to personal identity (your neural data can't be used to alter your sense of self)
- The right to free will (protection from technologies that could override autonomous decision-making)
- The right to fair access to cognitive enhancement

The question isn't whether we'll have the technology to access the human mind. We already do. The question is whether we'll build the legal, technical, and ethical frameworks to ensure that access remains a choice, not a condition.
